Vice President Richelle Montoya responds to independent preliminary investigation
of sexual harassment

The following statement is from Navajo Nation Vice President Richelle Montoya in response to the press release issued Dec. 16 by Navajo Nation Attorney General Ethel Branch, announcing the results of an independent preliminary investigation into sexual harassment allegations within the president’s office. However, no actual report has been provided.
“Though I am pleased that the independent preliminary investigation of my sexual harassment claim against President Nygren is finally complete, I am disappointed by the findings and appalled by President Nygren’s immediate celebration based on the information provided in a press release. I expect to receive a full copy of the investigation report to come to my own conclusions. I will not rely on a summary of the investigation provided in a press release.
“The alleged outcome of the investigation shows that even a high-ranking elected tribal official’s claims of harassment can be dismissed and disregarded. President Nygren did harass me that day in his office, and he has been harassing me every day since. He and his staff have created a hostile work environment for everyone to witness. The president has used every means at his disposal, including using the Navajo people’s money to hire an attorney, to attack, disparage, and disrespect me and my work as vice president of Navajo Nation. President Nygren is correct. This matter has divided our people, and his great efforts to silence me further exacerbates the rift within the Office of the President and Vice President and Navajo government.
“It is clear that our Navajo Nation laws need to be updated, and our leadership better educated about harassment and abuse that affects every office, every family, and every community across the Navajo Nation. As vice president, I call upon the Navajo Nation Council to review and update our codes, policies, and laws around sexual harassment, sexual abuse, and domestic violence within the workplace and across communities. Our people, women, and employees deserve to be protected and safe.
“From the beginning, the alleged independent investigation was questionable as the investigator was chosen by (Attorney General Ethel) Branch with influence by the Nygren Administration. The investigator also received no input, training, or support from domestic violence or sexual harassment advocates. Those advocates could have provided valuable guidance and insight on the many forms of harassment, examples of gaslighting, and signs of fear.
“Today, AG Branch also announced that the Nation is no longer working with that firm because of their massive delays in this investigation – which highlights the attorney general’s negligence in the matter as well. I acknowledge that AG Branch was working within the parameters of Navajo Nation Code and law. However, her removal by the Navajo Nation Council today shows the highest vote of no confidence in her abilities and judgment, and that speaks volumes.
“Earlier this year, I differed from the Nygren Administration when I saw first-hand the mistreatment of Navajo employees. I received countless messages from current and former Nation employees who have experiences with harassment, bullying, and retaliation, as well as the ongoing trauma that comes with it.
“Many have had to quit their jobs, change careers, or even move away to distance themselves from the abuse. I ask the Council to review the current employee sexual harassment training contract, training module and approaches with the intention of making responsible changes that put the Navajo people first. I stand by every survivor of sexual harassment, assault, abuse, and violence, including those fearful of coming forward.
“While much of my official resources were removed by President Nygren, I continue to serve as the Navajo people’s vice president. Thank you to all those who have shared kind words, thoughtful prayers, and continued support. A special thank you to all those who have shared their stories with me. I continue to carry you in my prayers.”
