Judge weighs motion to toss ethics case against Nygren

A Navajo Nation District Court judge is weighing whether to dismiss the ethics case against President Buu Nygren after hearing arguments Monday on the president’s bid to throw out the prosecution before it begins.
Judge Malcolm P. Begay took the matter under advisement following the hearing, at which Nygren appeared in person. The judge has not indicated when he will rule.
The hearing centered on a March 24 response from Special Prosecutor Kyle T. Nayback, who asked the court to reject each of the three grounds Nygren raised in his February motion to dismiss. Nayback argued that placing the case before an Executive Branch tribunal would be “patently unfair,” given that Nygren leads that branch, and wrote there is no evidence the law authorizing special prosecutors has disrupted its use since it was amended.
