Supreme Court to hear sexual harassment appeal

The Navajo Supreme Court will hold oral arguments Tuesday on a case involving a Navajo police employee who filed a claim against her supervisor for sexual harassment.

The hearing will be held at 10 a.m. at the Navajo Department of Transportation building east of Tse Bonito.

Falana Hadley is appealing a decision on March 31 by the Navajo Nation Labor Commission, which found that Hadley was not harassed.

Hadley is claiming that her supervisor at the Chinle Police Department, Dempsey Harvey, continually harassed her in numerous ways, including:

  • Telling her that he would not accept her as someone he wanted to be with in a romantic relationship,
  • Telling her to clean up his office, which was not part of her duties. She was a commissioned officer at the time,
  • Telling her that her then-fiancé, Dean Hadley, was too old for her and that he would deny her when she became pregnant. He also told her then-fiancé’s family would not want her because she was too young,
  • Watching her as she dusted, which required her to bend over with Harvey sitting in a chair behind her, among other things.
